Police Charge Pro-democracy activist with Sedition for Chanting "Five Demands and Not One Less" and Other Protest Slogans

Pro-democracy activist Tam Tak-chi, deputy chairman of People Power, was mentioned in Fanling Magistrates' Court on Sept 8, 2020, after being detained for more than 50 hours.

The police arrested Tam in Tai Po at noon on Sept 6, charging him with β€œsedition” and "causing others to hate or despise the government" under Article 10 of the Cap. 200 Crimes Ordinance.

In court, the prosecution claimed that the following phrases incite hatred for the government and the police.

1. "Liberate Hong Kong, Revolution of Our Times"
2. "Five Demands Not One Less"
3. "Corrupt Cop, May Your Whole Family Die"
4. "Disband the Police Force"
5. "[Police] Disppeared on 7.21, Murdered on 8.31 and Shot People on 10.1"

The court refused Tam's application for bail and the next hearing will be held on November 27, 2020. Tam was sent to Lai Chi Kok Reception Centre for further detention.

One day before the court, pro-Beijing channel TVB News had already released information: it was said that Tam from the end of June to August had been disseminating "seditious materials" by running street stations, speaking via loudspeakers, and publishing on social media platforms. These messages included "Down with the Communist Party" and slogans "Liberate Hong Kong, Revolution of our Times", and calling for "sanctions against officials". The pro-Beijing news channel described his behavior as "an attempt to provoke surrounding people."

Hongkongers in Solidarity with Detained Protesters and Activists

Hongkongers showed their support for pro-democracy protesters and acitivists outside of the detention center in Lai Chi Kok. Police were deployed in the area.

People displayed heart-shaped cardboard cutouts and signs that read "Freedom Will Triumph Over Fear", "Hong Kong Solidarity" and "Support Tam Tak-chi".

Tam Tak-chi is a pro-democracy activist in Hong Kong who was arrested by the police for sedition on Sept 6, 2020. The court has refused to grant him bail and he would be held in custody until next hearing on Nov 27, 2020.

Pro-democracy Legislator Chants Protest Slogans to Support Detained Activist; Police Deployed

Pro-democracy legislator Ray Chan of People Power continued the "anti-pandemic booth" originally run by fellow activist Tam Tak-chi, who has been arrested by the police for sedition on Sept 6, 2020.

Tam was still held in custody as the court rejected bail. The prosecution alleged that the pro-democracy protest slogans, including the familiar "Five Demands, Not One Less", chanted by Tam were "seditious".

If the court rejects bail again coming Thursday (Sept 17, 2020), Tam will face detention at least until November.

Before joining People Power, Chan and Tam used to work together as a TV and radio host duo, nicknamed 'Slow Beat' and 'Fast Beat' respectively.

At the booth run by Chan on Sumday, Sept 13, police were deployed.

#LawrenceLauWaiChung said, "Not guilty, sir," elegant as usual.

#LamCheukTing almost roared, "I don't plead guilty!"

#LeungKwokHung (a.k.a. #LongHair) said, "[I'm] Innocent. Plead not guilty."

#WinnieYuWaiMing raised her right hand and stated, "Not guilty."

The magistrate, Peter Law Tak Chuen, referred the 17 defendants to the High Court for trial.

The other 29 of them chose to plead guilty. Among them, #TiffanyYuenKaWai, #FrankieFungTatChuen, #CarolNgManYee, #GaryFanKwokWai and #HendickLuiChiHang, refused to agree all facts of the cases.

Everyone has a different way of pleading guilty:

#TiffanyYuen whispered, "Plead ah! (θͺε‘€οΌ)."

#FergusLeungFongWai said with a tone of no choice, "Plead guilty lo! (θͺε›‰οΌ)."

#FrankieFung said in Cantonese, "I plead guilty," then repeated in Mandarin, "I plead guilty, I know I was wrong,” causing the auditorium to laugh and #KwokKaKi thumbs up with a smile.

#LauChakFung just left his seat for the washroom, and somebody said, "he will plead guilty even in the toilet."

#JoshuaWong slowly spoke out, "Plead~ guilty~."

#LiKaTat shouted, "PG!"

#TamTakChi (a.k.a. #FastBeat) confidently said while brushing his hair, "I am 'handsome'" [Handsome has a similar sound as "plead" in Cantonese]

#WuChiWai followed, "Plead ah! (θͺε‘€οΌ)," looking at #TamTakChi, and they both laughed.

#SamCheungHoSum declared, "I plead, I plead, I plead (θͺε•Šθͺε•Šθͺε•Š)" in one go.

#VentusLauWingHong said, "For the love of my country, I plead guilty," raising uproar among defendants.

Law, the magistrate, asked whether the 26 defendants agreed with the case.

#AuNokHin stood up at that moment and expressed heavily, "I confirmed the case, and I would like to apologise to all defendants because I could not ensure the election was legal." He then slightly bowed to the defendants.

#AndrewChiuKaYin also apologized, but expressionless, "I confirm the overall case, and I apologise to everyone who helped in the pre-election." Some defendants jeered, "What are you saying (講呒啲)?"

#TamTakChi (a.k.a #FastBeat) shouted as usual, "I agree with the plot!", followed by a severe facial expression, "I agree, I agree (εŒζ„ε•Šγ€εŒζ„ε•Š)," which brought laughter to the courtroom. He then turned around, spoke to #ClaudiaMo, "Yes, excellent!" and raised his arms to the air with thumbs up.

#LeslieShumOFai interrupted, "I am not a comedy actor."

The magistrates confirmed whether Tam agreed with the entire case. He answered, "Yes, then I agree with the full case." Law raises the question once more, "You agree?" "The plot? Yes." Tam replied

It is understood that there will be no jury at the trial. This case will be handled by three designed judges, as in the case of #TongYingKit. It reminds us of #OwenChowKaShing, who did not plead guilty and yelled at the court after the restriction on reporting was lifted, "Trial without a jury is unjust."

This was probably the most potent conclusion in West Kowloon Magistrates' Courts for a year and a half.
