【赴湯杜火暴動案】上訴庭：「合謀犯罪」原則適用於暴動罪 不在場者同可被控

2019 年 7 月 28 日上環警民衝突，「赴湯杜火」湯氏夫婦與一名 17 歲少女被控參與暴動，三人去年 7 月獲於區域法院裁定罪名不成立，當庭釋放。惟律政司向高院上訴庭申請釐清法律議題，即「合謀犯罪」原則是否適用於暴動及非法結集罪，及如被告不在場，能否以「合謀犯罪」原則提控。案件早前經聆訊後，上訴庭今頒布書面判詞，指於證據充足下，可以「合謀犯罪」的相關原則，控告不在場人士暴動或非法結集罪。
上訴庭指，涉案者在場並非「合謀犯案」原則的先決條件，並舉例指策劃暴動或非法集結的幕後主腦、提供物質或基金者、以社交傳媒或電話鼓勵及宣傳非法集結或暴動者、提供支援及收集物資例如裝備、磚頭等供參與者使用的人士、於附近「把風」的人、及以車輛接載參與者逃離的人，均屬於合謀犯罪原則下的參與者，即使他們並不在場

In November 2019, #HongKong’s riot police besieged #CUHK, attacked it with teargas. Over 2,000 teargas shells were found on campus after two days of conflict. 2 years laters, students defending their campus and their lives were convicted of rioting. Every day we are given more examples of the death of #RuleofLaw in the city. The law a political tool bent by the #CCP at will to punish whoever refuse to kowtow.

#GeorgeOrwell wrote "Power is in tearing human minds to pieces and putting them together again in new shapes of your own choosing." This is what #CCP is trying to do in #HongKong. What can you do?
