【赴湯杜火暴動案】上訴庭：「合謀犯罪」原則適用於暴動罪 不在場者同可被控

2019 年 7 月 28 日上環警民衝突，「赴湯杜火」湯氏夫婦與一名 17 歲少女被控參與暴動，三人去年 7 月獲於區域法院裁定罪名不成立，當庭釋放。惟律政司向高院上訴庭申請釐清法律議題，即「合謀犯罪」原則是否適用於暴動及非法結集罪，及如被告不在場，能否以「合謀犯罪」原則提控。案件早前經聆訊後，上訴庭今頒布書面判詞，指於證據充足下，可以「合謀犯罪」的相關原則，控告不在場人士暴動或非法結集罪。
上訴庭指，涉案者在場並非「合謀犯案」原則的先決條件，並舉例指策劃暴動或非法集結的幕後主腦、提供物質或基金者、以社交傳媒或電話鼓勵及宣傳非法集結或暴動者、提供支援及收集物資例如裝備、磚頭等供參與者使用的人士、於附近「把風」的人、及以車輛接載參與者逃離的人，均屬於合謀犯罪原則下的參與者，即使他們並不在場

既知道那段歷史、既認同為着「自由」二字而付出赤誠的人值得被記住，悼念是不二之事。
Tiananmen Massacre vigil is prohibited, the publicising and advertising of the related assemblies and processions will also be the violation of Hong Kong national security law as announced by Security Bureau. The deprivation of the right to vigil is apparently a fact for Hong Kongers. How we keep going with our faith forges the relational space of our city.

Hong Kong Watch is formally launching a social media campaign encouraging people to mark the LegCo election that will take place on December19th 2021, by sharing a photo with the hashtag #ReleaseMyCandidate.
With this campaign, hope to send a message to the international community that these rigged elections do not reflect the voice of the Hong Kong people and to again call for the release of the 47 pro-democracy activists and 35+ primaries candidates who have been jailed for over 300days.
