受政府打壓而停牌年半嘅壹傳媒,由於無法復牌,喺上週四正式俾香港聯合交易所取消上市地位。

投資者合共7.65億港元嘅投資正式化為烏有。呢間香港傳媒巨頭,因政見同政府不合而被凍結資產、強逼停運、最終被逼清盤。港共維穩凌駕私有產權嘅思維令香港作爲國際金融中心嘅聲譽雪上加霜。

香港人請廣傳俾本地朋友同同事知道, 呢個曾號稱世界最自由經濟體喺中共摧殘下變成點樣,今時今日投資香港又面臨幾大風險。

Next Digital is a well-regarded listed company in Hong Kong founded by Mr. Jimmy Lai, focusing on media business, including the infamous newspaper "Apple Daily", with an estimated market value of HK$765 million (GBP 80 million).

The company ceased operations and suspended in Hong Kong stock market, after Hong Kong Police National Seurity Department raided their office, arrested their executives, and seized their assets in June 2021 for "National Security offenses". "National Security Law" was imposed on the city by China on 30 June 2020, tailored to oppress dissidents in Hong Kong.

Last Thursday (12/1/2023), Hong Kong Exchange announced the delisting of Next Digital for failing to resume trading by 16 December 2022, meaning investors' money is now vanished. Private Property Rights means nothing to the regime as far as politics is concerned, which further undermines Hong Kong's reputation as a global financial centre.

CCP's damage to Hong Kong, once the world's freest economy, is beyond repair and investors must think twice before investing in Hong Kong.

上一集提及壹傳媒被港共凍結資產導致被除牌,其實壹傳媒創辦人黎智英因為抗共立場被港共冠下大量政治罪。今集會和大家比較一下黎智英近期的判刑與之前同類型案件的分別,突顯現在香港司法不公的現實。
1.非法集結類
黎智英:
-2019 年8 月18 日、8 月31、10 月1 日及10 月20 日集會-- 未經批准集結罪,合共20 個月刑期。
-2020 年6 月4 日集會-- 煽惑他人參與未經批准集結罪,13 個月刑期。
之前同類型案件:
過往有其他議員也曾被控非法集結罪,卻是罰款和社會服務了事。

2. 煽動及勾結外國勢力類
黎智英:
-2020 年12 月 –被起訴《香港國安法》下勾結外國或者境外勢力危害國家安全
罪--該罪行可判處最高無期徒刑(終身監禁)。壹傳媒被凍結資產,蘋果日報於2021年6月24日發行最後一份報紙。
-2021 年12 月--串謀發布煽動刊物罪—等候量刑。
之前同類型案件:
1951年11月末,港英政府首次引用《煽動條例》控告《大公報》刊登煽動性文章。東主兼督印人費彝民及編輯李宗瀛,被罰款3000至4000元或者監禁六個月至九個月,承印人鮑立初則無罪釋放。《大公報》僅停刊12天就能重新復刊。港英政府對《大公報》並沒有趕盡殺絕。

3. 違反地契類
黎智英:
-2022 年12 月--違反地契的欺詐罪--監禁5 年9 個月, 罰款200 萬港元, 取
消擔任公司董事資格8 年。
之前同類型案件:
違反地契最嚴重的後果通常是釘契.在蘋果的控告中,使用欺詐罪刑事控告是第一次, 也是第一次由國安署接管違反地契案件。

CCP is invading the world – Episode 3

In the last episode, we mentioned that Next Digital was seized by the CCP and subsequently delisted from stock market. in fact, CCP is framing Next Digital founder Jimmy Lai with multiple political crimes for his anti-CCP stance.

In this episode, we will highlight the injustice in Hong Kong by comparing Jimmy Lai's recent sentencing with similar cases in the past.

1. "Illegal assembly"
Jimmy Lai:
-Assemblies on 18 August, 31 August, 1 October and 20 October 2019-- "organizing and participating in the unauthorized assembly" -— 20 months of imprisonment.
-Assembly on 4 June 2020 --"inciting others to participate in unauthorized assembly" —- 13 months of imprisonment.
Similar cases in the past:
Offenders (e.g. Some lawmakers) were fined and handed Community Service Orders.

2. " Colluding with foreign countries" and "conspiracy"
Jimmy Lai:
-December 2020 –- "colluding with foreign countries or external elements to endanger national security."— pending trail, up to life imprisonment. Seizure of Next Digital's asset forced AppleDaily to cease operation after publishing its last paper on 24 June 2021.
-December 2021 -- "conspiracy to publish seditious publications" -— pending sentencing.
Similar cases in the past:
In November 1951, the British Hong Kong government first applied the "Sedition Ordinance" to prosecute <Ta Kung Pao> (a pro-CCP news agency) for publishing seditious publications. Director Fei Yi-Ming and editor Li Tsung-Yin were fined HKD $3000 to $4000 and imprisoned for 6 to 9 months, while printer Pao Li-Chor was acquitted. <Ta Kung Pao> was banned from publication for only 12 days. The British Hong Kong government allowed opposition to exist.

3. "Violation of lease"
Jimmy Lai:
-December 2022-- "Fraud" for violation of lease -— 5 years and 9 months imprisonment, HKD $2M fine, and an eight-year disqualification order (for being company director).
This is the first time lease violation being criminalised, and the first time that the Office for Safeguarding National Security handles civil cases.
Similar cases in the past:
Violation of lease was treated as civil cases with penalties such as imposing encumbrances at Land Registry, or re-entry of the lot or vesting of the relevant interest to Government in worst case scenario. The actions taken by Government did not involve prosecution.

中共正侵略全球 – 第四彈

上集講到香港民主派人士、壹傳媒創辦人黎智英點樣被政治逼害,今次我哋會透過壹傳媒,睇睇中共係點樣喺兩年間摧毀香港新聞自由。

壹傳媒旗下蘋果日報創刊於1995年,反建制立場鮮明。自香港政權移交起,部份商家為免引起中共暴政反感而避免喺蘋果日報刊登廣告。2003年反對基本法23條本地立法、2012年反對國民教育、2014年撐雨傘運動、乃至反對普教中等都可見蘋果日報嘅反建制立場。

據Bloomberg 引述消息人士指出,2019年反送中期間,蘋果日報因長時間報導對港共不利嘅新聞,及鼓勵港人爭取民主自由,令港共認定壹傳媒係外國勢力代理人,為2020年港共率先剿滅壹傳媒埋下伏線。

2020年初蘋果日報就武漢肺炎要求港共封關(禁止任何人由中國入境香港),支持醫護罷工,以及國安法公佈至實施前持續同港共唱反調,令壹傳媒多次被港共政府及中共喉舌點名批評。

2020年8月10日,港共國安處上門拘捕多名壹傳媒管理層,並派逾二百人突襲壹傳媒大樓,喺未有出示搜查令嘅情況下大肆搜掠,大量物品,包括受保密協議保護嘅文件同新聞材料都被拎走。

事後港共國安處於記者會聲稱壹傳媒涉嫌違反國安法,獲法庭批出搜查令依法進行拘捕及搜證行動。惟根據消息,該手令唔包括編採新聞材料。

2021年6月17日,港共國安處再拘捕多五名壹傳媒董事,並派逾五百人搜查壹傳媒大樓,同時凍結其1800萬港元資產。蘋果日報被逼喺2021年6月24日發行最後一份日報後,於6月底宣佈停運。

據端傳媒報導,香港歷史上只發生過兩次執法人員搜查報館,分別係1967年六七暴動期間警方突擊搜查《新晚報》報社,以及2004年廉政公署曾經搜查包括《東方日報》、《蘋果日報》等8間報社。

正如 Bloomberg 所指出﹕「蘋果日報就好似一個門衛,當你消滅左佢,咁一切就完結。」一個個非建制媒體,緊隨壹傳媒之後相繼倒下。

除壹傳媒外,立場新聞、眾新聞亦分別於2021年底及2022年1月初停運,其中立場新聞多名高層被捕。更小型嘅獨立傳媒,包括加山傳播、知線新聞、香港獨媒新聞、傳真社等,自然無法倖免。

仍然留低,相對中立嘅傳媒,例如明報,亦受到來自港共嘅龐大壓力而要不斷加大自我審查,刊登時事評論甚至政治漫畫嘅空間不斷收窄。

另一方面,記者團體包結香港記者協會、香港外國記者會喺泰山壓頂嘅情況下,被逼暫停發新聞獎項,甚至租用會址都被強加國安條文限制,來自外國嘅職員因不滿港共限制新聞自由而辭職。

Previously, we talked about how Hong Kong pro-democracy activist and founder of Next Digital, Jimmy Lai, was persecuted. This time we will share how CCP destroys Hong Kong's press freedom in two years through the lens of Next Digital.

Next Digital's Apple Daily was founded in 1995, and its anti-establishment position was always clear.

Since the handover of Hong Kong in 1997, some businesses have avoided advertising in Apple Daily to avoid irritating CCP.

The anti-establishment stance of Apple Daily was persistent and can be seen in its opposition to the implementation of Article 23 of the Basic Law in 2003, its opposition to the national education curriculum in 2012, its support for the Umbrella Movement in 2014, and its opposition to using Mandarin as Chinese language instruction medium.

According to sources quoted by Bloomberg, during the Anti-Extradition Law Amendment Bill Movement in 2019, Apple Daily's prolonged coverage of news detrimental to the Hong Kong regime and its encouragement to Hongkongers to fight for democracy has led the Hong Kong regime to identify Next Digital as an agent of foreign countries and decided to eliminate Next Digital in 2020.

In early 2020, Apple Daily demanded the Hong Kong regime close borders with China to prevent the ingress of COVID-19, supported the medical staff strikes, and continued to oppose the Hong Kong regime until the enactment of the National Security Law. As a result, it led to repeated criticism from Hong Kong and the CCP regime, as well as state-backed medias.

On August 10, 2020, Hong Kong National Security Department (NSD) arrested several Next Digital top officials, more than 200 police raided Next Digital Headquarters. Without presenting any search warrant, they seized a large number of items, including documents protected by confidentiality agreements and journalistic materials.

Afterwards, NSD held a press conference and claimed that Next Digital was suspected of violating National Security Law and was granted a search warrant by the court to carry out arrest and search operations according to the law.

However, according to sources, journalistic materials were not covered in the warrant.

On June 17, 2021, NSD arrested five more Next Digital directors, sent more than 500 police to search Next Digital Headquarters and froze its assets amounting to HK $18 million.

Apple Daily was forced to cease operation at the end of June after its last issue on June 24, 2021.

According to Initium Media, law enforcement only searched newspaper offices twice in Hong Kong's history. The first was during the 1967 riots, where the police searched the office of a leftist press. The second was in 2004 when the Independent Commission Against Corruption searched the offices of eight newspapers, including Oriental Daily and Apple Daily.

As Bloomberg pointed out, "Apple Daily was like the guard at the gate. Once you take the guard out, that's it". Non-establishment media fell one by one, followed Next Digital's steps.

After Next Digital, Stand News and Citizen News were also terminated at the end of 2021 and early January 2022 respectively, in which top officials of Stand News were arrested.

Smaller independent news outlets, such as DB Channel, CLS News, Hong Kong Independent Media News, Factwire etc., were not spared, obviously.

The remaining news outlets with relatively neutral stances, such as Ming Pao, can't publish commentary and even political comics without self-censorship due to the enormous pressure from the Hong Kong regime.

Moreover, journalist organizations such as Hong Kong Journalists Association and The Foreign Correspondents' Club Hong Kong, were forced to suspend press awards amid extreme pressure, clauses in relation to national security were also added to the tenancy agreement of their office. Foreign staffs resigned to show their stance on Hong Kong regime's restriction on press freedom.

唔知大家仲記唔記得,2月24日係俄羅斯發動侵略烏克蘭戰爭一週年。

俄羅斯呢次入侵做成大量烏克蘭人民死傷,被迫離開家園成為難民者無數。呢場侵略戰爭對俄羅斯無論係人力同補給嘅消秏極大。士兵補充方面俄羅斯國內喺2022年9 月21日發出動員令,強迫最少30萬俄羅斯人參與侵略戰。由於受到國際社會制裁,俄羅斯經濟大受打擊,俄羅斯中央銀行預計2022和2023年的GDP將分別萎縮4%-6%和1%-4%。大家都會抱有一疑問,到底對俄羅斯係點樣堅持呢一場消耗戰?

華爾街日報本月初嘅報導為大家帶嚟一啲端倪。華爾街日報翻查俄羅斯海關數據並作出分析評估,發現中國的國有防務公司正在向受制裁的俄羅斯國有防務公司運送導航設備、干擾技術和戰鬥機部件,總船運量數以萬計。中國在向俄軍方提供繼續攻打烏克蘭所需的技術,未理會俄羅斯面臨的國際制裁和出口管制。更甚者,根據自由亞洲電台報導,中共利用香港作為白手套,不斷出口物資供應俄羅斯,令香港出口至俄羅斯貿易總額在去年十月跳升至4億美元,成為俄羅斯第七大貿易夥伴。
俄羅斯侵略烏克蘭曠日彌久,某程度上係因為有中共在背後支持。中共支持俄羅斯侵略一個主權獨立嘅國家,可見中共與其同盟國侵略世界嘅狼子野心。

You may be aware that the coming 24th February marks the first anniversary of Russia's invasion of Ukraine.
The invasion took away ten thousand of life in Ukraine, and many Ukrainians were forced to leave their home country and become refugees. At the same time, the invasion depleted resources of Russia too. Russia declared a partial mobilization of military reservists on 21st September 2022, forcing at least 300,000 Russians to fight in Ukraine. At the same time, due to the economic sanctions by the western countries, Russia suffered from a serious economic recession. The Central Bank of Russia estimated a 4-6% and 1-4% recession of GDP in 2022 and 2023 respectively. We all are wondering how Russia can maintain such a war of attrition.
A Wall Street Journal (WSJ) report in early February may explain some of its reasons. WSJ reviewed Russian customs data and revealed that China's state-owned defence companies had shipped navigation equipment and parts to fighter jets and other military technology equipment to Russian defence companies. China has sent tens of thousands of shipments of goods to service Russia's military. Moreover, CCP supplied a massive amount of goods to support Russia via Hong Kong, according to the report from RFA. In October last year, the trade volume between Hong Kong and Russia rocketed to 0.4 billion US dollars, and Hong Kong became the seventh largest trading partner with Russia globally.
The support from CCP backed up the long-lasting invasion of Russia on Ukraine. The fact that CCP aids Russia in invading an independent country like Ukraine reveals CCP and its counterparts' ambition to invade the whole world.

中共國自吹自擂,將白事當紅事辦大家都應該見怪不怪,但中共面皮厚到一個極點真係能人所不能。中共2月16日召開會議,吹噓: 「新冠死亡率保持在全球最低水平,取得疫情防控重大决定性胜利,创造了人类文明史上人口大国成功走出疫情大流行的奇迹」

大家都睇過中共前排白紙革命後突然放棄清零政策,突然解封加上前期防疫準備不足,疫情於全國大爆發,哀鴻遍野,連火化爐都一位難求。世界各國爭相對中國施以入境限制,以防疫症二次流行。如今中共竟敢厚顏無恥,話自己係死亡率最低?

根據衛報(The Guardians) 報導,中共聲稱只有83,150 人死於武肺。但自從清零政策突然放寬,中共只記錄醫院內武肺死亡人數,加上檢測由2022年12月9日的每日1.5億次急降至2023年1月23日的28萬次,中國年頭的死亡人數存疑。有學者透過年齡分布及疫苗率嚟推算,年頭呢波疫情死亡人數可達150 萬,遠高於美國總死亡人數(從疫情爆發開始計算)的110萬。

中共由武肺爆發以來謊話連篇,唔檢討自己不特止,仲要對自己歌功頌德。我哋有責任要俾世人知道呢個邪惡團體嘅卑劣行為。

China often brags and disguises tragedy with celebration. CCP held a conference on 16th Feb and bragged about itself as the “best” country in the pandemic by maintaining the “lowest” death rate globally. It claimed achieving great success and imposing a “miracle” of bringing the large population out of COVID. Is it really the truth?

As you all know, China has abandoned the “Zero COVID policy” after the “White Paper Revolution” earlier this year. However, the situation has burst into a disaster due to the sudden lifting of lockdown measures and the lack of preventive measures in the early stage. Some reported that the high death rate has even overloaded incinerators, which became incapable of handling such a large amount of deceased in the early months. At the same time, many countries tightened the border control from China to prevent another outbreak of COVID, which undoubtedly contradicted its statement of being the country with the lowest death rate.

According to The Guardians, CCP claims the total number of deaths in China due to COVID-19 is 83150. However, after lifting “Zero COVID policy” measures in China, CCP has changed the method of obtaining the statistics and limited the death rate to those who died in hospitals ONLY, excluding the numbers of deaths from all other places. In addition, the number of COVID tests done has dropped from 1.5 billion per day on 9th Dec 2022 to 280k per day on 23rd Jan 2023. There from the figures from CCP is probably biased and lack legitimacy.

Scholars have deduced the death rate in China by considering the age distribution and the vaccination rate. The deaths during the massive outbreak earlier this year should have reached 1.5 million. The figure is far more than the 1.1 million in the United States (starting from the beginning of the pandemic).

China has hidden the truth since the outbreak of COVID. No improvements were seen to be made but only propaganda. Therefore, we are obligated to unveil the evil acts of the CCP to the world.

Not long ago, the “White paper revolution” in China stopped the ridiculous Zero COVID policy. Chinese people held white papers to protest against the government. However, the evil instinct of the CCP won’t make everyone disappointed. A video clip showed Police in China conducting training on hiding the protestors by surrounding them with barriers made of blue clothes. The CCP never try to solve the problem; instead, they will silence the people who ask about it.

<初選無罪—在英港人聲援47人案聯合行動>
香港民主派2020年發起「立法會35+初選」,47人被控「串謀顛覆國家政權」罪。這是香港《國安法》生效後最大規模的案件,被告一旦罪成可判囚終身,但案件不設陪審團,主審法官為《國安法》三名指定高院法官。這案件是否有公平審訊引起國際廣泛關注。47名被告大部分人不獲保釋,至今已被關押超過700天,失去自由長達兩年才開始審訊。少數獲保釋人士則須接受苛刻條件,包括言論自由受限。

縱使現在開審時不斷爆出變節或是內鬼的事,我們不清楚47人中各有什麼想法或難處。 但我們必須明白,這件案件本身就是不公不義的事。在民主政制中為候選人舉行初選,以便選民能夠選出最能代表他們的候選人,增加候選人的代表性,這種做法根本完全合情合法,亦常見於世界各個民主社會。中共知道建制派支持度不夠高,強行拋出所謂「完善」選舉制度,亦運用嚴刑峻法去打壓泛民主派,令到他們所代表的香港選民的聲音在議會中消失。香港人的聲音被掩蓋,被活埋;香港人失去自由,失去法治,失去原本安居樂業之地。以上種種,都不是47人之過,亦不是其中有沒有人變節之過,始作俑者由始至終都只有一個,就是中共及其傀儡港共政權。

「初選無罪、政治打壓可恥」,昔日的他們願意企出黎為香港民主路發聲,現受打壓,受逼迫。然而香港受高壓極權統治底下,已經無人能夠為事件發聲。我們海外港人雖然人在異鄉,但我們擁有了發聲的自由,因此更要站出來支持聲援他們,讓世界了解中共港共的不公不義。
英國不同的地方團體/組織推動「在英港人聲援香港47人案共同行動」。希望在英港人支持及參與是次活動,聲援遭受政治逼害的47人以至其他在囚手足。

< Not Guilty— Stand with Hong Kong 47>
In 2020, the pro-democracy camp held a primary to select numbers of candidates for the September Legislative Council election to maximise the chance for the pro-democrats to achieve the "35+" majority in the Legislative Council. 47 pro-democracy advocates were charged with "conspiring to subvert state power" under the Hong Kong National Security Law (NSL). This is the largest national security case in Hong Kong after the implementation of NSL. Cases under the NSL are heard by specific judges handpicked by the chief executive and do not have a jury. The 47 are facing a maximum of life sentences. The fairness of the trial raises international awareness. The majority of the "Hong Kong 47" were held in custody without bail for over 700 days before their trial began. Only a few were granted bail, but with harsh conditions such as limited freedom of speech.

It is controversial for a few of the "Hong Kong 47" chose to become prosecution witnesses and testify against their co-defendants. Some may accuse them as traitors. We have no clue about their difficulties and worries, but we should realise that the "Hong Kong 47" case is injustice after all. It is absolutely lawful for the pan-democrats to hold a primary to allow their voters to choose their representatives. Through primary, the candidates' credibility and representativeness increase, allowing the people's voices to be heard in the Legislative Council. Primaries are commonly seen in democratic nations in the world, and it should never be a crime to hold a primary. The CCP knew that the pro-Beijing candidates were less popular than the pan-democrats.
