Barrister Worries National Security Law’s Imprisonment Before conviction: ‘To be released on bail is basic human rights’

The Hong Kong judicial system has been adhering to the principle of presumption of innocence, in which a defendant is innocent before conviction and should not be imprisoned unless there is sufficient reason to do so.

However, Jimmy Lai, founder of Apple Daily, who was charged by the police for fraud, as well as several defendants in cases related to the National Security Law were all denied bail by appointed judges and are imprisoned without trial.

A barrister worried that if the defendants whom the prosecution alleges are involved in a national security case will be denied bail, citizens will question whether the court has been reduced to merely symbolic.

Human rights organizations have also been heavily criticizing that these imprisonment before conviction are a serious violation of human rights.

The National Security appointed judge, Chief Magistrate Victor So denied Jimmy Lai’s application for bail. Lai will be remanded in custody until April 2021, which means he will be imprisoned for at least 4 months.

The senior officers of Next Digital, Chow Tat Kuen and Wong Wai Keung who were also charged with fraud were granted bail.

US Defense Adds SMIC and CNOOC to Blacklist

The US Department of Defense added four more Chinese companies, including SMIC and CNOOC, with alleged ties to the Chinese military restricting them from receiving certain goods and services from the US.

According to the US Department of Defense, Semiconductor Manufacturing International Corp. (SMIC), China National Offshore Oil Corp. (CNOOC), China International Engineering Consulting Corp., and China Construction Technology Co. are controlled or owned by the Chinese military, bringing the total number of blacklisted Chinese firms to 35.

In September, the US Department of Defense indicated that it was working on a decision on blacklisting SMIC. In the same month, the US Department of Commerce informed some companies that they need to obtain a license before supplying goods and services to SMIC as the products or equipment supplied could be used for military purposes and pose an “unacceptable risk”.

Walmart-exclusive router and others sold on Amazon & eBay contain hidden backdoors to control device

CyberNews researchers have discovered that Chinese-made wifi routers have secret backdoors which allow an attacker to not only remotely control the routers, but also any devices connected to it.

Backdoors are a means for an authorized or unauthorized person to gain access to a closed system – in this case, a router – by bypassing the standard security measures and take control, which is known as root access.

These Chinese-made low-cost routers, named as Jetstream, Wavlink and Ematic, usually are sold at Walmart, Amazon, and eBay.

CyberNews has also found evidence that an attacker has attempted to add the devices to a Mirai botnet, a malware which “infects devices connected to a network, turns them into remotely controlled bots as part of a botnet, and uses them in large-scale attacks.” It’s even possible that the router can steal your passwords on your devices no matter how many times you change them.

A 17-yrs-old male was acquitted of assaulting police in the execution of their lawful duties (Dec 25, 2019 in Telford Plaze).

The defendant was running away from another police, and crushed into the officer. No evidence to show any intention to have physical contact with the police.
